Documenting this Struggle for Trans Rights: A Compelling Documentary Shows the Personal Narrative

Transgender documentarian Sam Feder's newest film "Heightened Scrutiny" provides a powerful two-part perspective – simultaneously an personal portrait of a leading trans advocate and a sharp examination of media coverage about trans issues.

Judicial Battle at the Supreme Court

This documentary follows ACLU attorney Chase Strangio as he gears up for oral arguments in the significant highest court case the Skirmetti case. These arguments happened in December 2024, with the judiciary ultimately ruling in support of Tennessee's argument, effectively enabling bans on healthcare for trans minors to stay in place across multiple US territories.

We produced Heightened Scrutiny in merely 16 months, stated Feder during a conversation. Meanwhile, my previous film Disclosure took me five years, so this was a real push. Our purpose was to raise dialogue so people would understand more about the case.

Human Narrative Amid Political Struggle

Although Feder provides a comprehensive analysis of how mainstream publications have promoted anti-trans narratives, the film's most valuable achievement may be its engaging depiction of Strangio. Usually a measured attorney in public settings, Strangio shows his authenticity throughout the documentary.

This represented a major challenge, to open up aspects of my life to a documentary crew that I had made efforts to keep private, explained Strangio. Sam told me he wanted the next generation to know that we fought, to see what was done in support of these fights for our material survival.

Diverse Voices in the Movement

To support Strangio's narrative, Feder features multiple transgender advocates, including respected leaders from journalism and entertainment. The documentary also features viewpoints from non-trans advocates who critique how respected media outlets have added to negative coverage of transgender individuals.

The viewpoint of trans minors key to the legal case is represented through a impressive 12-year-old activist named Mila. Viewers observe her advocating for her peers at a educational meeting, with later moments showing her speaking for trans rights outside the highest court.

Intimate Scenes Beyond the Legal Battle

The documentary also features emotional moments where Feder transcends the constant political battle, including scenes of Strangio vacationing in Italy and getting a tattoo featuring words from civil rights leader Pauli Murray's poem "Prediction."

The tattoo moment is among my most cherished sections in the movie, explained Strangio. Receiving body art is nearly like a reflective experience for me, to be totally engaged in my body and to consider it as a vessel for things that are significant to me.

Body Autonomy and Portrayal

Feder's focus to thoughtfully showing Strangio getting to his body art highlights that Heightened Scrutiny is primarily about transgender bodies – not only those of young people who confront denial of their right to live genuinely in their own bodies, but also the physical forms of the numerous participants who participate in the production.

I make films with a message, and part of that is picking people who are outstanding and eloquent enough to sustain the camera, explained Feder. Whenever people ask me what they should dress for an filming, my answer is anything that makes you feel attractive. This is crucial to me – as transgender individuals, we have difficulties so much with our appearance.

Impact and Optimism

One factor that causes Feder's films stand out is his clear ability for making his transgender participants feel at ease, acknowledged and admired. This methodology develops genuine connection between Feder and Strangio, allowing the director to realize his aim of showing Strangio as a complete human being and leaving a document for future generations of how determinedly he and fellow activists have fought for transgender rights.

I don't want people to find themselves in a place of perpetual despair because of what the law is failing to provide us, explained Strangio. I strive to be in a process of using the law to reduce harm, but not to transform it into some type of conduit for our liberatory possibilities. State bodies is not going to be the reflection through which we view ourselves. Trans people are that mirror, and it's extremely important that we continue having that conversation in addition to dialogues about fighting back these regulations and practices.
